Local Rates: Seattle, SeaTac, Tukwila, Renton, Bellingham, Everett, Burien, and unincorporated King County have all set minimum wages higher than the state rate. You are entitled to whichever rate is highest in your area.
Computer Professionals: Hourly exempt computer professionals must earn at least $59.96 per hour in 2026 to qualify for exemption. Below that rate, overtime rules apply.
Washington Advantage: Rest breaks cannot be waived under any circumstances. Meal periods can be waived by mutual agreement, but rest breaks cannot. If your employer has been skipping your breaks, that is a violation worth looking into.
Worth Checking: Non-competes signed before Washington raised these thresholds may no longer be enforceable. If your employer is using one to restrict your work options, it may not hold up.
The Label Does Not Control: Washington looks past the contract language. If the day-to-day reality of your work looks like employment, the law will likely treat you as an employee.
