Ask Yourself…

✔  Have I ever gone home and still responded to work emails?

✔   Have I ever worked through my lunch or after my shift to launch a campaign?

✔   Have I ever had to prep a last-minute report before I clocked in remotely or before I head to the office?

If you answered yes to any of these questions, it’s worth checking your pay!

Just because it’s 10 minutes here and there doesn’t mean it shouldn’t be paid. Even if your employer doesn’t want you to record it, you still worked!

The Truth About Overtime

Salaried Doesn’t Mean Exempt

Many marketers are told they’re exempt from overtime simply because they’re salaried, not doing physical labor, or using specialized tools and software. But none of that automatically qualifies you for exempt status. The law has strict rules about who qualifies, and unless all those legal requirements are met, you may still be entitled to overtime pay.

To be legally exempt under the Computer Professional Exemption, you must be:

Person working on laptop with website design.
  • A computer programmer, systems analyst, or software engineer
Two people discussing contract over coffee.
  • And, paid at least $27.63/hour or a qualifying salary, depending on the state you are in

Just using a computer or creative tools doesn’t count, and your employer should know that!
If your role doesn’t meet that definition, you may be misclassified, and that means you are likely missing out on overtime pay.
