But none of that automatically qualifies you for exempt status. The law has strict rules about who qualifies, and unless all those legal requirements are met, you may still be entitled to overtime pay.

To be legally exempt under the Computer Professional Exemption, you must be:
- A computer programmer, systems analyst, or software engineer
- And, paid at least $27.63/hour or a qualifying salary, depending on the state you are in
Just using a computer or creative tools doesn’t count, and your employer should know that!
If your role doesn’t meet that definition, you may be misclassified, and that means you are likely missing out on overtime pay.
